TERMS & CONDITIONS OF CARRIAGE

1. DEFINITIONS

In these Terms & Conditions:

  • “SSP Delivery”, “we”, “us” or “our” means SSP Delivery Limited.
  • “Customer”, “you” or “your” means the person or business requesting or receiving our services.
  • “Goods” means the items, packages, consignments or other goods accepted for transportation.
  • “Booking” means an agreed request for our courier, collection, transportation or delivery services.
  • “Vehicle” means the vehicle used to carry out the Booking.
  • “Collection” means the agreed collection of the Goods.
  • “Delivery” means transportation and delivery of the Goods to the agreed destination.

2. APPLICATION OF THESE TERMS

These Terms & Conditions apply to courier, collection, transportation and delivery services provided by SSP Delivery Limited.

By requesting a quotation, making a Booking, accepting a quotation or using our services, you agree to these Terms, subject to any specific written terms agreed between you and SSP Delivery Limited.

These Terms should be read together with our Refund & Cancellation Policy and any other applicable booking information provided to you.

3. ABOUT SSP DELIVERY LIMITED

SSP Delivery Limited provides courier and transportation services, including same-day delivery, urgent delivery, collection and delivery of goods and other transportation services agreed with the customer.

Services may be carried out using vehicles operated directly by SSP Delivery Limited or, where appropriate, through an approved subcontractor.

4. QUOTATIONS AND BOOKINGS

All quotations are based on the information supplied by the customer.

A quotation may take into account:

  • Collection and delivery locations
  • Vehicle type
  • Mileage
  • Number of items
  • Weight and dimensions of the Goods
  • Number of collection or delivery points
  • Waiting time
  • Access requirements
  • Loading and unloading requirements
  • Special handling requirements
  • Other requirements communicated to us

A Booking becomes confirmed when SSP Delivery Limited accepts the Booking and provides confirmation to the customer.

A quotation may be amended if the information supplied by the customer changes or is found to be materially inaccurate.

5. PRICES AND ADDITIONAL CHARGES

The agreed price applies provided that the information supplied by the customer is accurate and the Booking is carried out as agreed.

Additional reasonable charges may apply where the actual requirements differ from those originally quoted.

Additional charges may include:

  • Additional mileage
  • Additional collection or delivery addresses
  • Additional stops
  • Waiting time
  • Parking charges
  • Tolls or road charges
  • Additional loading or unloading requirements
  • Changes to the delivery address
  • Failed delivery or additional delivery attempts
  • Additional handling
  • Specialist equipment or additional labour
  • Other reasonable direct costs arising from changes to the Booking

Where reasonably possible, we will inform the customer of significant additional charges before they are incurred.

6. PAYMENT

6.1 One-off and new customers

For one-off or new customers, SSP Delivery Limited may require payment in advance of Collection or before the Vehicle is dispatched.

Where advance payment is required, the Booking will not be confirmed until payment has been received.

6.2 Business customers

Business customers may be offered credit terms at the discretion of SSP Delivery Limited.

Any credit arrangement and payment period must be agreed in writing.

Unless otherwise agreed, invoices must be paid by the due date stated on the invoice.

6.3 Additional charges

Additional charges arising during or after a delivery may be invoiced separately.

Such charges are payable in accordance with the agreed payment terms.

6.4 Late payment

If a business customer fails to pay an invoice by the due date, SSP Delivery Limited may exercise any rights available under applicable UK late-payment legislation, including statutory interest and applicable debt-recovery costs.

Any statutory interest or recovery costs will be applied only where legally permitted.

6.5 Payment disputes

If a customer believes an invoice is incorrect, they should contact SSP Delivery Limited promptly and explain the reason for the dispute.

The customer should pay any amount that is not genuinely disputed in accordance with the agreed payment terms.

7. CANCELLATION

Customers should contact SSP Delivery Limited as soon as possible if they need to cancel a confirmed Booking.

Once a Booking has been confirmed, SSP Delivery Limited may have committed driver time, Vehicle availability, travel, administration and other resources to that Booking.

Unless otherwise agreed in writing, our standard cancellation structure may be:

  • After Booking confirmation: up to 25% of the agreed Booking price.
  • On the collection day: up to 50% of the agreed Booking price.
  • After the Vehicle has been dispatched: up to 100% of the agreed Booking price.

These are maximum amounts and are not necessarily automatic charges in every case.

Any cancellation charge will take account of the circumstances of the cancellation and the reasonable costs, time, resources and loss of Vehicle availability directly resulting from the cancellation.

Where reasonably possible, SSP Delivery Limited will take reasonable steps to reduce or avoid losses resulting from a cancelled Booking.

Cancellation charges will not be applied where doing so would be unlawful or where applicable consumer law gives the customer a right to cancel without such a charge.

Our Refund & Cancellation Policy forms part of the Booking information where applicable and explains how cancellations, cancellation charges and refunds are handled.

The Refund & Cancellation Policy should be read together with these Terms & Conditions of Carriage.

8. CHANGES TO A BOOKING

Customers must notify SSP Delivery Limited as soon as possible if any Booking details change.

Changes may include:

  • Collection address
  • Delivery address
  • Collection or delivery time
  • Number of items
  • Weight
  • Dimensions
  • Number of pallets or packages
  • Additional stops
  • Access requirements
  • Loading or unloading requirements
  • Vehicle requirements

We will make reasonable efforts to accommodate changes.

Additional reasonable costs resulting from a change may be charged to the customer.

Where reasonably possible, we will inform the customer of significant additional charges before the change is carried out.

9. CUSTOMER RESPONSIBILITIES

The customer is responsible for providing accurate and complete information.

The customer must provide, where applicable:

  • Full collection address
  • Full delivery address
  • Contact details
  • Description of the Goods
  • Approximate weight
  • Dimensions
  • Number of items
  • Special handling requirements
  • Access restrictions
  • Information about dangerous or restricted Goods

The customer remains responsible for the accuracy of the information supplied.

10. PACKAGING, LABELLING AND SECURING GOODS

Unless otherwise agreed, the customer is responsible for ensuring that the Goods are properly packaged, suitably protected, secure, correctly labelled where required and suitable for normal transportation and handling.

We may refuse to transport Goods that we reasonably consider unsafe, unsuitable or inadequately prepared for transportation.

Where loss or damage results from inadequate packaging, inadequate securing, incorrect labelling or a pre-existing defect, SSP Delivery Limited may not be responsible for that loss or damage to the extent permitted by law.

11. WEIGHT, DIMENSIONS AND VEHICLE CAPACITY

The customer must accurately describe the weight, dimensions and quantity of the Goods.

Goods must not exceed the legal or safe capacity of the Vehicle being used.

If the actual Goods exceed the Vehicle's legal payload, available loading space or safe capacity, SSP Delivery Limited may:

  • Refuse to transport the Goods;
  • Require a more suitable Vehicle;
  • Amend the quotation; or
  • Charge reasonable additional costs where additional arrangements are required.

We will not knowingly transport Goods in excess of applicable legal weight or safety limits.

12. LOADING AND UNLOADING

Unless specifically agreed otherwise, the customer is responsible for ensuring that Goods are ready for Collection and that suitable assistance or equipment is available for loading and unloading where required.

Our driver may provide reasonable assistance where it is safe to do so.

The driver is not required to manually lift or move Goods that are unsafe, excessively heavy or unsuitable for manual handling.

Specialist equipment, including forklifts, pallet trucks, tail lifts or additional labour, must be agreed in advance where required.

13. WAITING TIME

Included waiting time: 20 minutes for loading and 20 minutes for unloading.

Where additional waiting time occurs through no fault of SSP Delivery Limited, reasonable additional waiting charges may apply.

Waiting time may result from:

  • Goods not being ready
  • Customer or recipient not being available
  • Loading delays
  • Unloading delays
  • Lack of suitable access
  • Lack of loading or unloading equipment
  • Incorrect instructions
  • Delays at collection or delivery premises

Any applicable waiting charge will be communicated in the quotation or Booking confirmation where reasonably possible.

14. PROHIBITED, DANGEROUS AND RESTRICTED GOODS

Customers must inform SSP Delivery Limited before Booking if Goods are dangerous, restricted or require special handling.

Unless specifically agreed and legally permitted, we do not accept:

  • Illegal drugs or controlled substances
  • Explosives
  • Firearms or ammunition
  • Stolen goods
  • Goods prohibited by law
  • Undeclared dangerous substances
  • Goods that cannot legally be transported

We may refuse transportation where Goods create a legal, safety or insurance risk.

The customer remains responsible for complying with laws and regulations applicable to the Goods.

15. COLLECTION

The customer must ensure that the Goods are ready at the agreed Collection location and time.

If the Goods are not ready, additional waiting charges may apply.

If Collection cannot reasonably be completed because of incorrect information, lack of access, unsafe conditions or other circumstances caused by the customer, SSP Delivery Limited may charge reasonable costs associated with the failed Collection.

16. TRANSIT AND DELIVERY

We will make reasonable efforts to transport and deliver the Goods to the agreed address within the agreed timescale.

Unless expressly agreed in writing as a guaranteed delivery service, delivery times are estimates.

We will provide our services with reasonable care and skill and will take reasonable steps to meet agreed delivery times.

Nothing in these Terms removes or restricts any statutory rights that apply to consumer customers.

17. FAILED DELIVERY

If delivery cannot be completed because:

  • The recipient is unavailable
  • The address is incorrect
  • Suitable access is unavailable
  • Insufficient information has been provided
  • The recipient refuses the Goods
  • Goods cannot safely be unloaded
  • Other circumstances prevent delivery

SSP Delivery Limited may charge reasonable additional costs for waiting, return, storage, re-delivery or other necessary arrangements where permitted by the Booking and applicable law.

We will contact the customer where reasonably possible to obtain further instructions.

18. STORAGE AND RETURN OF GOODS

If Goods cannot be delivered and further instructions cannot be obtained within a reasonable period, SSP Delivery Limited may arrange reasonable storage or return of the Goods where necessary.

Reasonable costs for storage, return transportation, re-delivery or other necessary arrangements may be charged to the customer where permitted by the Booking and applicable law.

19. PROOF OF DELIVERY

Where reasonably possible, we may obtain proof of delivery, including:

  • Signature
  • Recipient name
  • Photograph
  • Electronic confirmation
  • Delivery date and time
  • Other reasonable delivery evidence

Customers should notify SSP Delivery Limited promptly if they believe there is a problem with a delivery.

20. LOSS, DAMAGE AND CLAIMS

SSP Delivery Limited will take reasonable care of Goods while they are in our custody or control.

Claims relating to loss or damage should be notified to us as soon as reasonably possible, together with reasonable supporting evidence where available.

Depending on the circumstances, we may request:

  • Proof of value
  • Photographs
  • Proof of packaging
  • Collection and delivery information
  • Proof of purchase or ownership
  • Other reasonable evidence necessary to investigate the claim

Claims remain subject to applicable insurance cover, the circumstances of the loss or damage, these Terms and applicable law.

21. INSURANCE

SSP Delivery Limited maintains Goods in Transit insurance with a stated sum insured of £10,000, subject to the applicable insurance policy, conditions, exclusions and limits.

The current policy also includes a stated £5,000 sub-limit and £100 excess, subject to the terms of the insurance policy.

SSP Delivery Limited also maintains Public Liability insurance of £1,000,000, subject to the applicable policy terms, conditions and exclusions.

Insurance cover does not mean that every loss, item or circumstance is automatically covered. Claims remain subject to the relevant insurance policy.

22. HIGH-VALUE GOODS

Customers must inform SSP Delivery Limited before Booking if the total value of the Goods is greater than £10,000.

SSP Delivery Limited may refuse to transport Goods above its available Goods in Transit insurance cover unless alternative arrangements have been agreed in writing.

Customers should not assume that Goods exceeding available insurance cover are automatically insured.

23. SUBCONTRACTORS

SSP Delivery Limited may use an approved subcontractor to carry out a delivery where appropriate.

Where a subcontractor is used, SSP Delivery Limited will take reasonable steps to ensure that the subcontractor is appropriately qualified, licensed and insured for the work being undertaken.

A subcontractor may maintain separate insurance cover, including Goods in Transit insurance of up to £50,000, depending on the subcontractor and the particular Booking.

A subcontractor's insurance does not automatically increase or replace SSP Delivery Limited's own insurance cover.

Any claim remains subject to the applicable insurance policy, the circumstances of the loss and applicable law.

24. LIABILITY

SSP Delivery Limited will be responsible for loss or damage to the extent required by applicable law and these Terms.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence;
  • Fraud or fraudulent misrepresentation; or
  • Any other liability that cannot legally be excluded or limited.

Subject to applicable law, SSP Delivery Limited will not be responsible for losses that are not reasonably foreseeable or for indirect or consequential losses where such limitation is legally permitted.

Nothing in these Terms removes or restricts any statutory consumer rights.

25. BUSINESS CUSTOMER LIABILITY

Where the customer is acting for business purposes, any contractual limitation of liability will apply only to the extent permitted by applicable law.

SSP Delivery Limited does not exclude or restrict liability where doing so would be unlawful.

Business customers should ensure that their own insurance is appropriate for the value and nature of the Goods they ask us to transport.

26. CUSTOMER INDEMNITY

To the extent permitted by law, the customer may be responsible for reasonable losses, costs or claims incurred by SSP Delivery Limited where those losses arise directly from:

  • Materially inaccurate information supplied by the customer;
  • Prohibited or undeclared dangerous Goods;
  • Inadequate packaging or securing;
  • Failure to provide required access or assistance;
  • Failure to comply with applicable legal requirements; or
  • Other acts or omissions for which the customer is responsible.

Any such claim remains subject to applicable law and must be reasonably incurred and directly connected with the relevant customer breach or act.

27. CANCELLATION BY SSP DELIVERY

SSP Delivery Limited may cancel or refuse a Booking where it is reasonably necessary to do so.

This may include circumstances where:

  • The Goods are prohibited or unsafe;
  • The Goods exceed legal or safe Vehicle capacity;
  • Materially inaccurate information has been provided;
  • The required Vehicle or equipment becomes unavailable;
  • The service cannot safely or lawfully be performed; or
  • Circumstances outside our reasonable control prevent performance.

Where SSP Delivery Limited cancels a Booking, any refund or charge will be considered according to the circumstances, the stage of the Booking and applicable law.

28. EVENTS OUTSIDE OUR REASONABLE CONTROL

SSP Delivery Limited will not be responsible for delay or failure to perform a service where the cause is outside our reasonable control, to the extent permitted by law.

This may include:

  • Severe weather
  • Flooding
  • Major traffic disruption
  • Road closures
  • Accidents
  • Vehicle breakdown
  • Fire
  • Industrial action
  • Government restrictions
  • Civil emergencies
  • Acts of terrorism
  • War
  • Other circumstances outside our reasonable control

We will take reasonable steps to minimise any resulting delay where reasonably possible.

29. COMPLAINTS AND CLAIMS PROCEDURE

If you have a complaint about our service, please contact SSP Delivery Limited as soon as reasonably possible.

We will investigate complaints fairly and reasonably.

Where a claim concerns lost or damaged Goods, we may request reasonable evidence to investigate the claim.

Nothing in this section removes any legal rights available to consumers.

30. PRIVACY AND PERSONAL DATA

SSP Delivery Limited may collect and process personal information necessary to provide its services.

Personal information will be handled in accordance with applicable data protection legislation and our Privacy Policy.

31. CONSUMER RIGHTS

Where the customer is a consumer, nothing in these Terms is intended to remove or restrict any statutory rights that cannot legally be excluded.

Our services will be provided with reasonable care and skill and, where no specific time has been agreed, within a reasonable time as required by applicable law.

Nothing in these Terms is intended to create an unfair contract term or remove a legal right that cannot legally be excluded.

32. BUSINESS CUSTOMERS

Where the customer is acting for business purposes, these Terms will apply subject to applicable law.

Business customers are responsible for providing accurate information about the Goods and delivery requirements.

Credit terms are only available where expressly agreed by SSP Delivery Limited.

33. CUSTOMER'S OWN INSURANCE

Customers remain responsible for considering whether they need their own insurance for the Goods, particularly where the value of the Goods exceeds the available SSP Delivery Limited insurance cover.

Customers should notify SSP Delivery Limited before Booking if additional insurance or special insurance arrangements are required.

34. REFUND & CANCELLATION POLICY

SSP Delivery Limited's Refund & Cancellation Policy forms part of the Booking information where applicable.

The Refund & Cancellation Policy explains the arrangements relating to cancellation requests, cancellation charges, refunds, failed collections, failed deliveries and services that have already started.

Customers should read the Refund & Cancellation Policy together with these Terms before making a Booking.

Where mandatory consumer law applies, the customer's statutory rights will prevail.

35. CHANGES TO THESE TERMS

SSP Delivery Limited may update these Terms & Conditions from time to time to reflect changes to our services, business practices or applicable law.

The Terms applicable to a particular Booking will normally be those in force when the Booking is accepted, unless otherwise agreed in writing or required by law.

36. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be modified or removed only to the extent necessary.

The remaining provisions will continue to apply to the extent permitted by law.

37. GOVERNING LAW AND JURISDICTION

These Terms & Conditions and any contract between SSP Delivery Limited and the customer are governed by the laws of England and Wales.

Subject to any applicable consumer rights, disputes will be subject to the jurisdiction of the courts of England and Wales.

38. ACCEPTANCE OF THESE TERMS

By requesting a quotation, accepting a quotation, making a Booking or using SSP Delivery Limited's services, the customer confirms that they have had a reasonable opportunity to review these Terms & Conditions and the applicable Booking information.

Where a Booking is made by or on behalf of a business, the person making the Booking confirms that they are authorised to do so on behalf of that business.
